Anyone help me?

I just had a mobile phone bought for me by my GF and she will be first she to admit she knows nothing about phones. I wanted one with the facility to record and capture video, the one i got doesnt have this facility. I went to return it and was told electronic goods are exempt from refunds (which amazed me). I was then informed my reciept would also show electronic goods are exempt, i noticed this and was none to happy.

I examined the catalogue my GF used to purchase the phone and noticed it had an icon that said the phone has video capture, and even an explanation on what video capture meant, the facility to record using the phone. I then had a look at Trading Standards and noticed i can claim a refund if the item is misdescribed. Have i a good case, im not really after a cash refund (though the way the store has been i should) credit would do me fine. Have i a leg to stand on?

Was the catalogue produced by the store you purchased from? If so, yes; they misrepresented the products they are selling.

If the catalogue was from a different store/organization, however, then the situation becomes much more tricky; you would have to go after the catalogue producer, not the store, in that case, as it isn't their problem if you obtain incorrect information about their product, so long as you didn't get that incorrect information from them.

Whoever made that catalogue and incorrectly advertised the item on that large of a scale screwed the pooch. If you were going to sue someone, the maker of the catalogue would be in.

However, if all you want is store credit, I am sure the store will be more than happy to do that for you, since you were given very bad information and you are going to do return business in their store
