Their were four off us all of us 18 at least. so were at the public park and somone apparently called the police becuase it was after dark. Which is not posted newhere at the park that you cant be their after dark and we have been many times b4 this. So after being their for 30 minutes 3 cops show up. One uses the built in megaphone on his car and ask us to walk over to him. We all do so. They all get out of their cars and tell us to stand their. He starts asking us why were at teh park so late. (only thing im thinking is its seven o clock). Well he starts with me and ask me to walk over to his vehicle and ask me if im alright with being searched. I said yes cause I dont do drugs and had nothing on me. well he shines the light in my eyes and tell me my eyes are glassy and ask me if ive been smoking weed. I say no, he tell me to open my mouth (at this point im like wtf does he need to see inside my mouth) I open my mouth and he asks me to stick out my tongue. He then tell me that my tongue is green and is now accusing me of smoking marijuana. I dont smoke but plentyof my friends do and ive never noticed a green tongue. You should have told him, that he is not a physician to make that assumption. And that his comment has no legal basis. A good way to have people stop harassing you, especially with this many witness, is to ask him for his ID number and First/Last Name. This is what you need to file a complaint. Most authority will start to treat you with respect at the moment you hint that you are going to fire a complaint. But then of course i live in Europe. Not USA, so you are probably going to jail because your tongue was green. Are they supposed to ignore every call they get because it's probably just some kids messing around? What if that specific park has been vandalized in the past? What if people witnessed drug deals or violent attacks in that same park? Yes, maybe they were being a ridiculous for harassing them, but then again, maybe they have reasons to, since teenagers and young adults are generally known for causing trouble, even if it is harmless. In short, they were doing their job. Something that contributes to a declining society in a positive way. What is it you do again? Next time say hell no you can not seearch me, take the ride down town, call your folks and sue for harassment. I would like to see the officer tell the judge your green tongue gave him probably cause for a search. Likely he would end up suspended if he retained his badge. He played upon your ignorance of your rights, in effect using the "Wizards First Rule" against you. It took 13 of the motherf***rs just to arrest me and two friends for curfew when we were sixteen. We didnt run or anything we were walking cop pulled up behind said hold right their we did and then more just slowly kept coming because the clearly had nothing else to do but ? a bunch of 16 years out after 11pm. I was just curious as to the whole green tongue thing I have to meet anyone who has said yes. It cool I think im still able to get harrassment since the two other officers both agreed my eyes were glassy and my tongue was green i ugh got paranoidand went to the hosipital you know cause i dont smoke pot lol. got their and was like my tongue is green and my eyes were glassy since i dont smoke pot I thoght their was something wrong. Me and the doctor laughed for like 20 mintes he filled out a bunch of paperwork and was the one who told me to go file a harrasment suite cause they really dont leave me alone and they never find anything on me. If you don't want to consent to a search, tell them so, but be polite about it. Cops will generally be reasonable with you if you don't smart-mouth them. If you talk crap, they will start thinking of ways they can be a pain in your arse. Also, don't assume that cops are idiots regarding the law. I graduated from law school this time last year and it's amazing how many people (especially law students) think that it's a good idea to start telling the cops what the law is. Cops generally have a very good idea of what the laws are that directly concern them, and what they can/cannot do. I'm not saying you were doing this, it's more of a general advice. If you do get arrested or taken in, it's nearly always a bad idea to talk to them without a lawyer present. Even if you know you're innocent. People who are innocent sometimes tend to over-exaggerate their innocence because they know they didn't do anything, but this can make you look like you're lying later on. Cops are very good at getting people to say what they want them to say, or getting you to say things you don't mean. It's pretty much their job. If you get arrested, don't talk to them without a lawyer present. Even if you think you don't need one. If you get taken in and are not under arrest, you can leave at any time. It's ok to answer questions, but if they start asking you questions you aren't comfortable with you should either ask to leave, or say you're not comfortable answering those questions. The police cannot arrest you JUST to ask questions. If they place you under arrest, they have to have enough evidence to actually charge you with something right then and there. My overall advice: Cops are generally not out there to give you crap for no reason, they are generally trying to do their job. If they are asking you to do things you don't want to do, don't do it. But be polite about it, and don't start acting arrogantly or smart-mouthing them. If you think you're being harassed unfairly, I think you should contact a local legal center, or somewhere where you can get free or very cheap legal advice. After the dog finds nothing, and you blow clean tell him thank you, ASK HIM FOR YOUR AFTER DARK CITATION, then do not pay it, but go to court on the date stated on the citation. He then stated his tongue was green, I was like hmmm what he do eat it and had leaves on his tongue. I didnt know it was now seemingly a mandatoy statement to see if perhaps you would say oh wow really i didnt know it would do that here here is my stash dude. You should have said you were eating green apple fun dip and asked him if he wanted any. First of all if your 18 and there wasn't any signs posted to not be there, then you can be there. If none of you were doing anything suspicious when they pulled up, then in all honesty they shouldn't be brow beating you with questions and asking you to come to their cars. I have smoked copious amounts of marijuana and my tongue has never turned green. If it smells like Bull**** then it probably is, especially coming from a cop. Also the reason the cop said it was so supicous was because of the fact that were in college and it was a playground on a saturday night. The most recent was this playgorund thing were we were all 18. oh and nekky I dontt get smart with them. I do my best to be plite but they really do try and push it. One time I pulled up to a check point at 12 o clock at night on my way home from work and I pulled up and said "how is it going guys" just kinda casually talk to them as i would nebody else. Wrong thing to do at this point since i didnt refer to the officer only a year older then me as officer or sir he accused me of being disrespectful and a search and a breathlyzer later I went home. Back in 1990 I was informed that all public parks in the state of Oklahoma were closed to the public after sundown and before sun up. Excluding camping areas where you would subsequently be asked for your camp ground receipt by the park rangers. So the officers were doing there job. This law came about do to people actually getting injured playing after dark, these folks tried to sue the state claiming there should be fences around the public parks to prevent such tragic accidents. However, that is no excuse for harassing you, lying to you, and trying to trick you into admit wrong doing. I would also add that the worst trouble I ever got into was do to actually striking an officer in the park after dark. Hey, when your homeless and asleep and someone grabs you violently waking you up, you COME UP SWINGING! Three days in county not on charges of assaulting an officer but for vagrancy. The officers said I should have found somewhere to live. The judge through the case out and had an officer drive me to the city limits where he parked and watched to be sure I did not walk back into town.... Good Times. The smoke itself does not turn your tongue green, so perhaps the idea is that, for instance, if you are smoking from a joint some amount of unburnt cannabis may find its way into your mouth and the chlorophyll found therein may stain your tongue. Then a green tongue may be a sign of smoking a joint, or drinking green tea or eating celery. After reading on the thread I decided to do a bit of research. Funnily enough I was watching cops last night and a cop told a kid that he had a green tongue so therefore he had been driving under the influence. (Watch it on Hulu). While normally I would think nothing of it, after seeing the thread, like I said, I looked it up, and that's one of the articles I've found among many who have completely debunked the idea. If you are being harassed repeatedly, I think you should go to seek free legal advice. I don't know about the U.S but in Australia there are places called community legal centers. I work at one right now, it's on the campus of my University. Basically they are funded by the government, and the staff is paid by the government. All the advice and work they do for clients is free to the client. They give legal advice on any issue, ranging from how to contest a parking ticket to how to write contracts and protect intellectual property rights. There are a lot of people out there who act like they know what they're talking about, and are in positions of authority (be it a police officer or a guy working in a store) who try to bully or con you out of your legal rights. For example: A good friend of my brother's had a neighbour's tree blow down in a storm and fall into his back yard where it crushed his caravan. He wrote letters to his neighbour asking them to replace it, but they talked fast and had him believing that because it was blown over in a storm it wasn't actually their responsibility. He was about to pay for the caravan himself, and it was a pure fluke that I heard him and my brother talking about it and got him to contact a local legal center. They helped him write letters to the neighbours saying the right thing, and within 2 weeks they had paid for the damage. My brother bought a Nokia mobile phone that stopped working. He went in to the store where he bought it and asked for a refund. The pushy manager of the store said "We just sell the phones, we don't make the phones. It's not our problem if it breaks." My brother didn't know any better and took their word, though he was annoyed about it. He was complaining to me about it and I went in with him to speak to the manager. I said that they were responsible because they had a contract with my brother to provide goods, and the phone was screwed so it was in breach of that contract. I said I had already called the Department of Fair Trading and was prepared to go to local court over the issue. We left with a new phone. Long story, I know. But the point is, if someone is giving you crap - don't always believe that they know what they are talking about. I'm not saying you should argue with the cops right there in the street - that is often a bad idea. But you should try and get legal advice if you can. You would be surprised how many people are doing things that they have no right to do and getting away with it because their 'victims' are ignorant of their rights. Be polite, be respectful - but don't let talk you into something you don't want to do. If the police truly want you to do it they can compel you under certain circumstances ie you have committed an offense. I ride a motorcycle - and as most riders know, the police can be downright unfriendly to those on two wheels. A good friend of mine, after getting stopped, had the officer walk up to him with an obvious attitude. The easiest way to have the officer put his manners back in? - my friend calmly took out his mobile phone from his pocket and said: "Good morning officer. I'm going to record our conversation on my mobile for my records. What can I do for you?" That police officer suddenly became a model of politeness to the public. You can ask for an officers identification etc too and they must provide it. I'm pretty sure they don't have to give you a pen and paper to write it down, but if you have that take a note. Most officers realise that should anything happen you now do have everything you need to file a complaint - and this usually results in all being done the correct way. No brow beating. No fast talking by a blue clad authority figure. Being overly aggressive, forceful and intimidating is what SOME (not all) police do. Bullies wearing blue are still bullies - and like all bullies when stood up to they don't have a great deal of anything to back them up. That all being said - police do a tough job and have to deal with a lot of scumbags in their line of work. Being direct and assertive is simply a form of self defense. We even have 15 days experience period, in which we can break contracts, (after signing). "Good morning officer. I'm going to record our conversation on my mobile for my records. What can I do for you?" But on other hand, you cant tape conversation without the consent of the people involved. If you do not get it, it's void in court.
