Imoutgoodbye Posted November 26, 2006 Report Share Posted November 26, 2006 Sheesh.... Well, my new car, bought on a loan from a bank, that I've only had since Ocboter 3rd, is down and out. And being held from me. I took my fiance out to dinner in Midland (semi-big town) and a lady pulled out in front of me. She got the ticket. Neither me nor my fiance were hurt, nor was the other lady. Flat tire, punctured my radiator resoirvoir, headlight knocked in (not broken), and the strut was broken with some minor damage to the bumper and quarter panel on the passenger side. However, the tow company that the cop made me take (I was some fifty miles from home and they couldn't wait for my tow company) is now holding my vehicle because they wouldn't deal directly with my insurance company. I have full coveraga via Unitrin Direct (who the tow company claims to have never heard of) and the body shop I had the car towed ALL THE WAY home to wouldn't write a check to be re-imbursed by the insurance company because it's not there policy. Here's the crappy part. I had the money on the way. My fiance's mother was going to loan it to me, but the tow guy's boss told him "not to wait, they had business to take care of." So, they took my car, charged me for a two-way tow (100 miles total) and charged me an impound fee, so when the money showed up, it wasn't even half of what I needed anymore. I just hope there's SOMETHING I can do because this all seems so bogus. EDIT: The car's a 97 Olds Achieva. I did file my insurance claim, but because of the holiday, the appraisal team won't get to the impound lot until Monday. Link to comment Share on other sites More sharing options...

Why wouldn't they deal directly with the insurance company? Again, with my poor knowledge on US law I wouldn't really know what to say to do. Other than punch the boss of the alternate tow company. But that was terrible night so was the following day gosh we must have went through two packs of cigs that night alone, I've really gotta quit smoking. What state you are in: Original Fee for the tow and the agreement you made with the driver: Fee for the impound: CALL YOUR INSURANCE AND SEE IF THEY COVER TOWS: Whos fault was the accident: Did the other driver have Insurance...I think that's all I need. All I know is Texas Traffic law but it is regulated by the federal government. Assuming that what I know is true, unless you were the faulted party, meaning you caused the wreck, all of the expenses incurred from the wreck are hers. You shouldn't be going through YOUR insurance, but hers. Citations don't bean jack by the way, it doesn't stand up in court without your own personal documents. Chayesh Posted November 27, 2006 Report Share Posted November 27, 2006 You would go through your insurance company if you have collision coverage. They would then fight her insurance company for you. If you only have liability insurance (what most states require), then it's you against her insurance company. Good luck with that. Don't settle until you add up the money you are out of pocket and they pay you enough to cover it all. This is assuming she is totally at fault, then, yes, her company should be paying you for all of it, the tow, repairs to your vehicle, medical bills, compensation for pain and suffering, the whole shooting match.
